Yes it is Birmingham, probably 1909 but I don’t recognize the maker JN & Co ?

The lighter is indeed hallmarked Birmingham 1909. The maker is John Nobbs & Co. The reason you may have had difficulty identifying the maker is because John Nobbs & Co is a London based silversmith and typically used the London Assay Office. An example of their mark can be seen below. The font is a little different, but such variation is not unusual.
